Terms of use

Effective 13 September 2026. Version 1.0.

These Terms of Use (Terms) govern your use of the current Wakeletics app for iPhone (the App) and the features made available through it. The App is provided by Wakeletics (referred to as “Wakeletics”, “we”, “us”, or “our”).

By downloading, purchasing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. App Store licence

The App is licensed, not sold. Your licence to use the App is also subject to Apple’s Standard Licensed Application End User License Agreement and the App Store Usage Rules. These Terms supplement the Standard EULA. If these Terms conflict with the Standard EULA on a matter governed by the App Store licence, the Standard EULA controls to the extent of that conflict.

Apple is not responsible for providing support or maintenance for Wakeletics. Questions about the App should be sent to wakeletics@gmail.com.

2. Who may use Wakeletics

You must be legally able to agree to these Terms. If you are below the age of legal majority where you live, a parent or legal guardian must review and accept these Terms and supervise your use of the App and its exercise features.

Wakeletics is not directed to children under 13. Do not use the App in a way that violates applicable law or Apple platform rules.

3. What the current App provides

Wakeletics combines locally scheduled alarms with camera-verified squats or push-ups. Depending on your settings and Wakeletics Pro status, the App may also provide backup alarm chains, local reminders, workout history, progress and streaks, personal weekly challenges, share cards, custom sounds, app icons, and other personalization features shown in the App.

The current release has no Wakeletics account, server-hosted profile, friend network, Wake Circle, shared leaderboard, or cloud social challenge. Features described as future or planned on another Wakeletics website are not part of these Terms until they are actually released and these Terms are updated.

4. Health and exercise safety

Wakeletics asks you to exercise shortly after waking. Exercise carries a risk of strain, falls, collision, pain, and other injury. Wakeletics is not a medical device, medical service, emergency service, personal trainer, or substitute for professional healthcare advice.

Before exercising:

  • make sure you have enough clear, stable, and well-lit space;
  • place the iPhone securely where it will not fall or create a trip hazard;
  • choose an exercise and repetition target you can complete safely;
  • consider advice from a qualified healthcare professional if you are pregnant, injured, unwell, have a relevant medical condition, or are unsure whether the exercise is suitable for you.

Stop immediately if you feel pain, dizziness, shortness of breath, weakness, or anything unusual. Never continue exercising merely to preserve a streak, earn points, complete a challenge, or retain a statistic.

The Workout Gate includes Emergency Dismiss, which ends the Wakeletics backup chain without requiring you to finish the exercise. It is always available and is not a Wakeletics Pro feature. Using it may record the morning as incomplete and may affect a streak or challenge, but safety comes first.

5. Alarm limitations

Wakeletics schedules alarms and disclosed backup rings using Apple’s AlarmKit. Every ringing AlarmKit alert retains Apple’s system Stop control. Wakeletics does not hide, remove, replace, or intercept that control and does not claim that an alarm is impossible to dismiss.

Alarm delivery and presentation depend on iOS, device state, permissions, volume and audio behaviour, available system capacity, software updates, and other conditions outside Wakeletics’ control. A paired Apple Watch may also present system alarm controls according to Apple’s behaviour.

You are responsible for checking that the intended alarm is armed and that the device is charged and operating normally. Do not rely on Wakeletics as the sole alarm for medication, emergency response, care of another person, travel, examinations, employment, legal deadlines, or any other event where a missed alarm could cause serious harm or loss. Use an independent backup where the consequence matters.

6. Camera verification

Camera-based repetition counting is an assistance feature, not a measurement of medical condition, exercise quality, athletic ability, or personal identity. Lighting, clothing, framing, obstruction, camera position, device performance, and movement style may affect counting. Wakeletics does not guarantee that every valid repetition will be counted or that every invalid movement will be rejected.

You remain responsible for safe form, safe surroundings, and deciding when to stop. Information handling for camera frames and optional share-card photos is described in the Wakeletics Privacy Policy.

7. Your photos, sounds, names, and share cards

You retain ownership of content you choose or create, including a display name, profile photo, share-card photo, voice recording, or imported audio file. Wakeletics stores and processes that content locally only to provide the feature you selected.

You represent that you have the rights and permissions needed to use any content you import or share. Do not import or distribute content that is unlawful, infringing, threatening, abusive, deceptive, or that violates another person’s privacy. Do not use Wakeletics to copy or distribute DRM-protected music or other content without authorization.

When you choose to share a card through Apple’s share sheet, you direct the selected third-party app or recipient to receive it. Their terms and privacy policy apply after the share. Wakeletics does not control or retrieve content you have shared to another service.

8. Wakeletics Free and Wakeletics Pro

Wakeletics Free is the permanent base version and does not expire. The core wake flow, camera-verified squats and push-ups, system alarm controls, and Emergency Dismiss are not conditioned on purchasing Wakeletics Pro.

Wakeletics Pro is an auto-renewable subscription offered through Apple’s in-app purchase system. The current App may offer monthly and annual plans that unlock the same Pro entitlement for different billing periods. The exact price, currency, billing period, available features, and any introductory offer are shown in the App Store purchase interface before you confirm.

At launch, Pro features may include unlimited active alarms, full local history and insights, the full Wakeletics sound collection, custom app icons, voice recording, and supported user-owned audio import. The purchase screen is the authoritative description of what is included at the time you subscribe. Pro does not buy Wake Points, improve scoring, protect a streak, or create a ranking advantage.

9. Subscription billing, trial, renewal, and cancellation

Payment is charged by Apple to your Apple Account when you confirm the purchase. Subscriptions automatically renew for the same billing period unless cancelled through your Apple Account before the renewal is processed. Apple determines the applicable renewal timing, taxes, exchange rates, payment authorization, and billing rules.

The annual plan may include a seven-day introductory free trial for users Apple determines are eligible. A trial applies only when Apple displays it in the purchase interface before confirmation. If no trial is displayed, no trial is included.

You can manage or cancel the subscription through your Apple Account’s subscription settings. Deleting Wakeletics or using Delete all data does not cancel a subscription. Cancellation stops future renewal but does not normally end access before the current paid period expires, subject to Apple’s rules.

Purchases, refunds, billing disputes, and restoration are processed by Apple and are subject to Apple’s terms and applicable consumer law. Wakeletics cannot view your payment method or issue an App Store refund directly. The App provides a Restore Purchases function for eligible purchases.

10. Subscription changes and availability

Apple or Wakeletics may change a subscription price in accordance with App Store rules and applicable law. Apple will provide any notice or request for consent required for a price change.

We may improve, replace, or discontinue individual Pro features as the App evolves, provided that we continue to comply with applicable law, accurately describe the subscription before purchase, and provide the ongoing value required for an auto-renewable subscription. We will not place Emergency Dismiss or Apple’s required system alarm controls behind a paywall.

11. Privacy

The current App is local-only and has no Wakeletics account or backend. Our Privacy Policy explains local storage, camera and microphone use, sharing, StoreKit, permissions, retention, and deletion. The Privacy Policy forms part of these Terms.

12. Acceptable use

You must not:

  • interfere with the App, its security, purchases, alarm scheduling, or verification mechanisms;
  • attempt to obtain paid functionality without authorization;
  • use the App or share-card features to violate law or another person’s rights;
  • distribute malicious code through content selected for use with the App;
  • reverse engineer, decompile, disassemble, or create derivative works from the App except where applicable law or an open-source licence expressly permits it;
  • misrepresent Wakeletics as a medical device, emergency service, Apple product, or product endorsed by Apple.

13. Intellectual property

The App, its software, interface, graphics, sounds supplied with the App, branding, and documentation are owned by or licensed to Wakeletics and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

Wakeletics, the Wakeletics logo, and associated brand elements may be trademarks of their respective owner. You may not use them in a way that suggests ownership, sponsorship, or endorsement without permission.

14. Third-party and Apple services

The App relies on Apple platform services such as AlarmKit, local notifications, Vision, StoreKit, Photos and document pickers, the share sheet, and optional device backup. Those services are supplied by Apple and are subject to Apple’s terms and privacy practices.

If you choose a third-party destination through the share sheet or select a file stored by another provider, that third party’s service is governed by its own terms. Wakeletics is not responsible for third-party content, availability, or data handling outside the App.

15. Updates and availability

We may release updates to maintain compatibility, security, safety, legal compliance, or functionality. Some features may require a supported iPhone, operating-system version, camera, or Apple service. We do not guarantee that the App or every optional feature will always be available, uninterrupted, or free from errors.

The current App is not a promise that planned account, cloud, friend, Circle, leaderboard, or other social functionality will be released.

16. Suspension and termination

You may stop using the App at any time. You may delete local App information through Settings and may delete the App. Subscription cancellation is handled separately through your Apple Account.

We may restrict future access to services we control if reasonably necessary to protect users, comply with law, enforce these Terms, or protect the App. The current local-only App does not include an account that Wakeletics can remotely disable.

17. Disclaimers

To the maximum extent permitted by applicable law, the App is provided as is and as available. We do not promise that an alarm will always fire, that the App will prevent oversleeping, that every repetition will be counted perfectly, or that use of the App will produce a particular fitness, health, productivity, or habit result.

Nothing in these Terms excludes warranties, remedies, or statutory rights that cannot lawfully be excluded.

18. Limitation of liability

To the maximum extent permitted by applicable law, Wakeletics is not liable for indirect, incidental, special, or consequential loss arising from use of or inability to use the App, including a missed alarm, interrupted sleep, lost data, missed appointment, or loss caused by relying on a streak or repetition count.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or death or personal injury where applicable law prohibits such a limitation. Your mandatory consumer rights remain unaffected.

19. Changes to these Terms

We may update these Terms when the App, subscriptions, or applicable requirements change. The effective date above will be updated. Where a change materially affects your rights or an active subscription, we will provide notice as required by applicable law or App Store rules. Continued use after an effective update constitutes acceptance only to the extent permitted by applicable law.

20. Contact

Questions about these Terms or the App may be sent to wakeletics@gmail.com.
